TERMS OF SALEThese Terms govern purchases made through the natasha naomi studio online shop
natasha naomi studio is operated by a New Zealand sole trader and is in trade for the purposes of New Zealand consumer law
These Terms take effect on Monday 27 July 2026
ACCEPTANCE OF TERMS
By placing an order and accepting these Terms at checkout, you agree to be bound by them
These Terms must be read together with the Terms of Use, Shipping and Returns Policy and Privacy Policy published on this website
If an inconsistency arises in relation to a purchase, these Terms of Sale prevail to the extent of that inconsistency
ELIGIBILITY TO PURCHASE
You must be at least 18 years old to place an order
If you place an order on behalf of another person, business or organisation, you confirm that you are authorised to accept these Terms on their behalf
ARTWORKS AND AVAILABILITY
Every artwork is an original and unique work unless its listing expressly states otherwise
All orders are subject to availability. Submitting an order does not reserve an artwork or create a binding contract. A contract is formed only when cleared payment has been received in full and natasha naomi studio has sent written confirmation that the order has been accepted
natasha naomi studio takes reasonable care to keep availability information accurate. If an artwork becomes unavailable after an order is submitted, you will be notified promptly and any payment received will be refunded in full
natasha naomi studio reserves the right to decline or cancel an order if an artwork is unavailable, a listing or pricing error has occurred, payment has not been received within the period stated on the invoice or there are reasonable grounds to suspect fraud, unauthorised payment or an otherwise invalid transaction
Any payment received for an order cancelled by natasha naomi studio will be refunded in full to the original payer
ARTWORK INFORMATION
Materials, dimensions, presentation and other relevant details are stated on each artwork page
Artworks are sold unframed unless the relevant listing expressly states otherwise
natasha naomi studio takes reasonable care to represent each artwork accurately. Screen calibration, lighting and display settings may cause minor differences in colour and tone
Surface texture, material variation and evidence of the artist's working process are inherent characteristics of each artwork and do not constitute faults
Nothing in this section limits your rights if an artwork is materially different from its description
PRICING
All prices are stated in New Zealand dollars
natasha naomi studio is not registered for GST. GST is not charged
The price displayed when an order is submitted is the artwork purchase price, subject only to the correction of an obvious listing or pricing error before the order is accepted
Shipping within New Zealand is complimentary. No shipping charge will be added at checkout
Prices may change before an order is submitted. Once an order has been accepted, its price will not change
ORDERS AND PAYMENT
Submitting an order constitutes an offer to purchase the selected artwork
An invoice will be issued through Hnry to the email address supplied at checkout. Payment must be made in full by online bank transfer using the Hnry account details shown on the invoice
An order is accepted only after cleared payment has been received in full and natasha naomi studio has sent written confirmation of acceptance
No artwork will be dispatched before cleared payment has been received
You are responsible for ensuring that the name, email address, telephone number and delivery details supplied at checkout are complete and accurate
DELIVERY
Delivery is currently available only within New Zealand
Artworks are dispatched using DHL. Each shipment is fully insured, trackable and requires a signature upon delivery
Delivery is available only to physical street addresses. DHL does not deliver shipments to post office boxes
Please allow 3–5 business days for processing before dispatch
Tracking details will be provided once the order has been dispatched
Delivery times after dispatch depend on the destination and DHL service conditions. Any stated delivery timeframe is an estimate and is not guaranteed
natasha naomi studio will investigate and address any delivery delay, loss or damage and will comply with all obligations under New Zealand consumer law
DELIVERY DETAILS
You must provide a complete and accurate physical address where the shipment can be received and signed for
natasha naomi studio is not responsible for delays caused solely by incomplete or inaccurate information supplied by you
If a shipment is returned, redirected or requires redelivery because the information supplied was incomplete or inaccurate, you are responsible for the reasonable additional delivery costs
Please contact studio@natashanaomi.com promptly if delivery details need to be changed. Address changes cannot be guaranteed after the shipment has been dispatched
DAMAGE IN TRANSIT
Each artwork is carefully packaged using appropriate protective materials to ensure safe arrival. Please inspect the shipment promptly upon delivery
If an artwork or its packaging appears damaged, photograph the exterior packaging, interior packaging and artwork before disposing of any materials
Please notify studio@natashanaomi.com within 48 hours of delivery where reasonably practicable so that the damage can be assessed and an insurance claim can be lodged with DHL
The request for notification within 48 hours does not limit any right or remedy available under New Zealand law

RETURNS AND CHANGE OF MIND
All artwork sales are final where the purchaser changes their mind and purchases should be made carefully
natasha naomi studio does not offer a refund, return or exchange because you have changed your mind, no longer want the artwork or for any other reason unrelated to a fault, damage on delivery or misdescription
This change-of-mind policy does not limit your rights where an artwork is faulty, damaged on delivery, materially different from its description or otherwise fails to meet a guarantee under New Zealand consumer law
FAULTY OR MISDESCRIBED ARTWORKS
If you believe an artwork is faulty, damaged on delivery or materially different from its description, contact studio@natashanaomi.com as soon as reasonably practicable and provide clear photographs and a description of the concern
Do not return an artwork before receiving return instructions from natasha naomi studio
If an artwork fails to meet an applicable statutory guarantee, natasha naomi studio will provide the remedy required by law. Depending on the nature and seriousness of the failure, the remedy may include repair, replacement where available, refund or compensation
natasha naomi studio is not responsible for damage caused after delivery by misuse, alteration, accidental damage, unsuitable display conditions or failure to follow the published care guidance. This does not affect any remedy relating to a separate failure covered by law
CONSUMER RIGHTS
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other applicable New Zealand law
The statement that artwork sales are final applies only to change-of-mind purchases and does not remove statutory rights concerning faulty, damaged or misdescribed goods
COPYRIGHT AND OWNERSHIP
Purchase transfers ownership of the physical artwork only
Copyright and all other intellectual property rights remain with natasha naomi studio unless expressly assigned under a written agreement
Purchase of an artwork does not grant any licence or permission to copy, reproduce, publish, distribute, alter, commercially exploit or otherwise use the artwork or any image of it
The artwork and any image of it must not be used for artificial intelligence training, machine learning, dataset creation, text or data mining or automated extraction without prior written permission from natasha naomi studio
Additional provisions governing website content and intellectual property are set out in the Terms of Use
PRIVACY
Personal information supplied during checkout will be collected, held, used and disclosed in accordance with the Privacy Policy and the Privacy Act 2020
Personal information may be used to process the order, confirm payment, issue an invoice, arrange delivery, provide tracking information, respond to enquiries and meet legal, tax or accounting obligations
Personal information may be disclosed to Rocketspark, Hnry, DHL and other service providers only to the extent reasonably necessary to complete or administer the transaction
Order confirmations, invoices, delivery updates and other communications directly relating to a purchase are transactional communications and may be sent whether or not you have opted to receive marketing communications
LIABILITY
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited
To the maximum extent permitted by law, natasha naomi studio is not liable for loss or damage caused by incomplete or inaccurate information supplied by you, misuse or alteration of an artwork, failure to follow the published care guidance or events beyond reasonable control
natasha naomi studio is not liable for indirect or consequential loss unless that loss was reasonably foreseeable when the order was accepted or liability cannot lawfully be excluded
CHANGES TO THESE TERMS
natasha naomi studio may amend these Terms by publishing an updated version on this website. Each updated version will state the date on which it takes effect
The Terms accepted at checkout and in effect when an order is placed will apply to that order
GENERAL CONDITIONS
A failure or delay by natasha naomi studio in enforcing any provision of these Terms does not waive that provision or any associated right
If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force
Notices relating to an order will be sent to the email address supplied at checkout
For these Terms, a business day means Monday to Friday excluding public holidays observed in New Zealand
GOVERNING LAW
These Terms and all purchases made through this website are governed by the laws of New Zealand
The courts and tribunals of New Zealand have non-exclusive jurisdiction over disputes arising from these Terms or any purchase
